This document sets out the terms and conditions of sale applicable to any purchase made from BILLONE SAS France - hereinafter referred to as the Billone Company - whose legal information is reproduced below.

For all purchases made on the Website/Application www.golden-indigo.com – hereinafter referred to as the Website – the General Terms and Conditions of Use [https://www.golden-indigo.com/legal/cgu] apply, and the terms defined therein shall have the same meaning in these GOLDEN INDIGO General Terms and Conditions of Sale, with the exception of the term "Event." The term "Event" in these GOLDEN INDIGO General Terms and Conditions of Sale refers to any Event of any kind whatsoever, including any performance, whether theatrical, visual, or musical, organized by the Billone Company.
This document sets out the terms and conditions of sale applicable to any purchase made from BILLONE SAS France - hereinafter referred to as the Billone Company - whose legal information is reproduced below.
1.1 Through the Site, Billone Company offers access to Events reserved primarily and exclusively for its Members benefiting from a paid formula as well as additional services related to these Events.
1.2 The events and services offered by Billone are subject to a fee. The cost of each paid service is listed, along with any additional conditions that may apply.
1.3 Events are not automatically accessible to Members. Access conditions will be determined for each Event based on capacity or other criteria that may be decided by Billone.
In all circumstances, the conditions of access to Events are established by Billone. Billone will monitor these conditions at each Event, upon the arrival of guests and during the event itself, to ensure compliance with guidelines such as the proposed theme and the proper conduct of Members and/or participants.
Participation in Golden Hours Events is conditional upon full compliance with the Charter (https://www.golden-indigo.com/charte).
2.1 The prices for original Golden Hours Events and any services will be systematically mentioned.
2.2 The price for each service or original Golden Hours Event specifies the details of the offer and any special conditions.
Anything not explicitly mentioned in the offer purchased by the Member/participant is the sole responsibility of the latter.
2.3 The price will be quoted inclusive of all taxes and the details of these will be mentioned in the summary and in the invoice.
3.1 Payments are made on the Site/Application using our payment subcontractor Stripe exclusively by credit card.
3.2 Exchange rate fees for payments are solely the responsibility of the user/member.
3.3 From the date of registration and in accordance with Article L. 221-28 of the Consumer Code, the User/Member expressly waives the benefit of the fourteen (14) day withdrawal period if one of the paid Services is used.
3.4 In accordance with Article 121-21-8 12° of the Consumer Code, the right of withdrawal cannot be exercised for a purchase related to Events and services relating to the organisation of accommodation, logistics, catering and other leisure activities which must be provided on a specific date or during a specific period.
Therefore, no reservation can be cancelled or refunded except in the event of a justified case of force majeure directly affecting the Member/participant. The reservation amount may be refunded upon acceptance by Billone.
3.5 The purchase of a ticket to participate in an Event and additional services may not be transferred or resold to a third party or between Members without the prior written consent of Billone. If a reservation is transferred or resold without this prior consent, the ticket holder will be refused entry, the seller may be penalized (up to and including exclusion from the Site), and legal action may be taken against Billone SAS France for breach of these terms and conditions.
3.6 The Member agrees and accepts that they can only purchase one ticket per Event (or two tickets in the case of a Duo account).
4.1 All orders will only be confirmed after receipt of written confirmation from Billone Company, subject to effective payment.
4.2 Furthermore, order confirmation will only be final after validation of any formalities related to travel, if applicable.
4.3 In the event of non-payment occurring after confirmation of the order and in the absence of regularization, the order may be cancelled by the Billone Company.
5.1 Because your privacy is our priority, Billone Company undertakes to take all necessary care to preserve it and never resell it to a third party.

6.1 The exact destinations, national or international, of our original Golden Hours Events will be communicated 3 months in advance to keep a hint of mystery and flavour.
Administrative formalities for admission to the countries can be handled by Billone Company and/or possible subcontractors, which will require accurate and up-to-date data on your travel situation (identity card and/or passport, visa, vaccinations, power of attorney to carry out the formalities, proof of residence if applicable).
In this context, the organization of the Event may require the organization of travel. In this case, travel information will be provided for each Event and will comply with the provisions of Articles L.211-1 et seq. and R. 211-1 et seq. of the French Tourism Code, where applicable.
Therefore, and by way of exception given the nature of the Event offered by the Company, the Member validating their purchase accepts without reservation and definitively
6.2 The Member agrees to provide all necessary documents for each destination, including a power of attorney authorizing Billone to handle the formalities, identification/passport, and answers to questions requested by the relevant countries. Billone shall not be held liable for any failure by the Member or participant to provide the necessary documents or for providing incorrect information.
6.3 Billone Company does not decide on the acceptance of entry formalities into a territory. Therefore, the refusal of a visa or entry authorization for a Member will prevent them from confirming their order. The Member will then be refunded for their order.
6.4 Members and participants agree not to bring food, drinks, animals, illicit or dangerous substances or dangerous objects into the Events.
6.5 Billone Company also reserves the right to remove or refuse entry to any Members/participants under the influence of alcohol and/or drugs, as a safety measure for said person and those around them, or for failure to comply with the instructions, dress code and themes of the Event.
The Members/participants concerned accept that no compensation or reimbursement from the Billone Company will be possible.
6.6 Members and participants in our original Golden Hours Events agree to comply with all security measures given to them, whether contractual, displayed on the Site or during the Events or given orally by security personnel.
6.7 Any damage to the premises or harm caused to Billone or any third party, resulting from failure to comply with these provisions or inappropriate behavior (including verbal or physical violence), may be subject to legal action to seek compensation for the harm suffered and may lead to exclusion from the Site. Consequently, the Member understands and accepts that legal proceedings may be initiated against them.
6.8 Events inherently include music, light, and the presence of a cheerful crowd.
Therefore, for safety reasons, particularly in the event of an emergency evacuation, Members/participants whose condition is particular and may require special precautions are advised to contact Billone to ensure that the event is suitable for their condition.
Billone Company cannot be held liable in the event of non-compliance with this provision.
6.9 Billone Company prohibits all types of recording during Events. Therefore, the use of video and/or audio recording devices (including, but not limited to, mobile phones, cameras, drones, and GoPros) is strictly forbidden. Any use of such a device will result in the Participant's exclusion from the Event and the Website, without prejudice to any potential legal action. Consequently, the Member understands and accepts that legal proceedings may be initiated against them.
6.10 Members/participants agree with Billone not to disclose details of Event experiences, directly and/or indirectly, and not to disclose the identity of other Members/participants without having obtained their prior written consent.
Any partial and/or total disclosure without prior consent would violate the privacy of Members/participants and the confidential and commercial interests of Billone. In such a case, Billone may exclude the Member/participant from the Site and initiate legal proceedings. Consequently, the Member understands and accepts that legal action may be taken against them.
7.1 Billone Company's liability is limited to the amounts invoiced.
7.2 However, any event outside the control of Billone Company, including political or social events (strikes, brawls, etc.), health events (epidemics, etc.), natural events/disasters (storms, weather events, etc.) or which may be classified as force majeure, preventing the Company from delivering the Services, shall not engage its liability.
8.1 The Member expressly declares that, prior to his purchase, he was informed in a clear and understandable manner of the essential conditions of the Services, the prices of additional fees, the date of delivery of the Services, the identification information of the Billone Company, the information relating to guarantees and liabilities and the alternative dispute resolution mechanisms through in particular the General Terms and Conditions of Sale and presentation of the Services.
In order to favor an amicable solution, the following alternatives can be used:
8.2 This Site and all related rules are governed by French law, regardless of the place of use. In the event of any dispute, and after all attempts to reach an amicable solution have failed, the French courts shall have exclusive jurisdiction to rule on the dispute.
8.3 The Member/participant acknowledges that documents written in French prevail over those written in English.
8.4 If a clause of these General Terms and Conditions of Sale of GOLDEN INDIGO should be cancelled by a final decision or one not subject to appeal, the contract and the other unaffected clauses shall remain in effect.

The Data will be processed as long as the Services are used or from the end date of the Event for those related to the organization of the trip and may then be kept for a period equal to the applicable limitation periods for each of them.
In accordance with applicable regulations, each data subject has rights regarding the processing of their personal data, including the right to information, access, rectification, erasure, restriction of processing, objection, data portability, the right to define directives in the event of death, and the right to lodge a complaint with the supervisory authority. The User/Member is informed that they can access their account at any time to access, modify, delete, and download their personal information and data. This information will then be automatically and permanently modified and/or deleted from the database.
